A European Arrest Warrant (EAW) can be issued by any EU member state if the alleged offence could result in a prison sentence of at least one year or if the person requested has been sentenced to at least four months imprisonment Once the EAW has been issued, an arrest can be made by the police in any EU member state.
There are a number of bars to extradition that can be raised to resist extradition and in every case the Judge must decide whether a person’s extradition is compatible with the European Convention on Human Rights.
If the Judge orders a person’s extradition there is an automatic right of appeal to the High Court against that decision.
